HC relief for 418 families to be challenged

Kalyan: A day after the Bombay high court granted relief to 418 families of Mohan Regency and an English-medium school here by staying an order issued by the Kalyan-Dombivli Municipal Corporation (KDMC) for cancellation of development permission granted in 2002, the civic body has decided to challenge it.
KDMC chief E Ravindran said on Wednesday they would demolish the building after the monsoon if they get the court's permission.
An HC bench of Justices S S Kemkar and M S Karnik, hearing an urgent plea moved by Mahadev Homes, had on Tuesday said the civic chief's order was "illegal, arbitrary and unjust".
Harshad Bhadbhade, the counsel for the developer, had argued that the KDMC chief had passed the order without granting a proper hearing to his client.
The KDMC had on July 11 acted on a complaint by RTI activist, Shreenivas Ghanekar, that Landmark Constructions had obtained permission in 1995 in collusion with the land owner, K J Rajkotwala, in violation of the Urban Land Ceiling Act, by claiming extra land.
KDMC officials said they granted a hearing to the developer before taking a decision, but he failed to produce proof.
